Terms of Service / End-User License Agreement: Are You Ready?

These Terms of Service ("Terms") are a binding agreement between you and BAMF Apps LLC ("BAMF Apps", "we", "us") governing your use of the Are You Ready? game and related services (the "App" or "Service"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial entertainment, subject to these Terms and the rules of the platform you obtained it from (Apple App Store / Google Play). You may not copy, modify, reverse-engineer, resell, sublicense, or create derivative works from the App except as permitted by law.

2. Eligibility

The App is not directed to children under 13, and you must be at least 13 years old (or the minimum age of digital consent in your country) to use it. By using the App you represent that you meet this requirement.

3. Accounts

Accounts are optional; you may play as a guest. If you create an account (via Google, Apple, or email), you are responsible for activity under your account and for keeping your sign-in method secure. You agree to provide accurate information and not to impersonate others or choose a username that infringes another's rights or is offensive. We may reclaim or change usernames that violate these Terms.

4. Gameplay, fairness, and the "one rule"

The App is an endurance game in which prompts arrive unpredictably and you must respond before a countdown expires. The server is authoritative for all timing and outcomes. You acknowledge and agree that:

  • Whether you "made it" is determined solely by whether your tap reached our server before the deadline. There are no grace periods, reconnect windows, or retries.
  • Missing a prompt for any reason (including a device being off, asleep, offline, in Do Not Disturb, with notifications disabled, or a delayed/undelivered push) results in elimination, and this is by design.
  • We do not guarantee that push notifications will be delivered on time or at all; delivery depends on your device, OS, network, and third-party push providers (Apple, Google, browser push services), which are outside our control.

5. Virtual items

The App includes in-game items such as "PowerPoints" currency, XP, levels, achievements, and power-ups. These are earned through play, have no monetary value, cannot be purchased with real money, and cannot be exchanged for cash or anything of value. We may modify, suspend, adjust balances, or discontinue virtual items at any time. You have no ownership or property right in any virtual item.

6. Acceptable use

You agree not to: cheat, exploit bugs, use bots/automation, tamper with or intercept game traffic, attempt to forge taps or manipulate timing, access non-public systems (including the admin interface), harass or abuse other players, or use the App for any unlawful purpose. We may suspend or terminate accounts that violate these rules.

7. User content

Limited user-provided content (such as your display name and friend connections) must not be unlawful, infringing, harassing, or offensive. You grant us the right to display this content within the Service as needed to operate it (e.g., showing your name to other players and on leaderboards).

8. Privacy

Your use of the App is also governed by our Privacy Policy (https://bamfapps.com/apps/are-you-ready/privacy), which is incorporated into these Terms by reference.

9. Service availability and changes

The App is provided as an evolving service. We may add, change, suspend, or discontinue features, modes, matches, or the Service as a whole at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROMPTS/NOTIFICATIONS WILL BE DELIVERED RELIABLY OR ON TIME.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAMF APPS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED USD $50 OR THE AMOUNT YOU PAID US FOR THE APP IN THE PRIOR 12 MONTHS (WHICH, FOR A FREE APP, IS $0), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold BAMF Apps LLC harmless from any claims, damages, or expenses arising out of your misuse of the App or violation of these Terms.

13. Termination

You may stop using the App and delete your account at any time (https://bamfapps.com/apps/are-you-ready/delete-account). We may suspend or terminate your access for violation of these Terms. Provisions that by their nature should survive termination (e.g., disclaimers, limitation of liability) will survive.

14. Governing law

These Terms are governed by the laws of the State of Hawaii, USA, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Hawaii, unless applicable law grants you the right to bring a claim elsewhere.

15. Apple and Google app-store terms

If you obtained the App from the Apple App Store or Google Play, you also agree to that platform's terms. You acknowledge that these Terms are between you and BAMF Apps LLC, not with Apple or Google, and that Apple and Google are not responsible for the App or its support. Where applicable, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.

16. Changes to these Terms

We may update these Terms from time to time. We will post the revised version here with a new "Effective date." Continued use after changes take effect constitutes acceptance.
