BAMF Books: Terms of Service / End-User License Agreement

These Terms of Service ("Terms") govern your use of BAMF Books (the "Software"), published by BAMF Apps LLC ("we," "us," "our"). By installing, deploying, or using the Software, you agree to these Terms. If you do not agree, do not use the Software.
1. What BAMF Books is
BAMF Books is self-hosted double-entry bookkeeping software. You install and operate it on infrastructure you control. We provide the software; we do not host it for you, and we do not access your instance or your data.
2. License
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to install and use the Software for your own bookkeeping. You may not remove proprietary notices or misrepresent the origin of the Software. Any open-source components are licensed under their own terms, which control for those components.
3. Your responsibilities
You are responsible for:
- Hosting, securing, configuring, backing up, and maintaining your instance and database.
- The accuracy of the data you enter and import, and for the credentials (SimpleFIN, Stripe, ERP service keys, etc.) you supply.
- Complying with the terms of any third-party service you connect, and with all laws applicable to you.
- Managing user accounts and access within your instance, and safeguarding the encryption key (
LEDGER_SECRET_KEY) and other secrets.
4. Read-only financial connectivity
The Software's integrations are read-only. BAMF Books retrieves financial data; it does not initiate transfers, payments, trades, or any movement of money. You are responsible for the financial decisions and filings you make using its output.
5. Not professional advice
BAMF Books is a bookkeeping tool, not accounting, tax, legal, or financial advice. Matters such as accounting basis (cash vs. accrual), entity tax treatment, payroll provider choice, and tax-filing obligations are decisions for you and your CPA or attorney. We are not your accountant. Verify your books and reports independently before relying on them for tax or legal purposes.
6. Third-party services
The Software can connect to third-party services (e.g. SimpleFIN, Stripe) using credentials you provide. Your use of those services is governed by your agreements with them. We are not responsible for third-party services, their availability, their data practices, or any fees they charge.
7. Availability and changes
The Software is provided as-is and may change over time. Because you host it, its availability is up to you. We may release updates, modify, or discontinue features, and we are not obligated to provide support, maintenance, updates, or backward compatibility.
8. Disclaimer of warranties
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, THAT BOOKKEEPING RESULTS OR REPORTS WILL BE ACCURATE OR COMPLETE, OR THAT IT WILL MEET YOUR REQUIREMENTS.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FINANCIAL/TAX CONSEQUENCES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SOFTWARE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SOFTWARE IN THE PRIOR TWELVE MONTHS OR USD $50.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your use of the Software, your data, your configuration, or your violation of these Terms or of any third party's rights.
11. Termination
You may stop using the Software at any time by uninstalling it. We may terminate the license granted in these Terms if you materially breach them. Sections that by their nature should survive (e.g. 5, 8, 9, 10, 12) survive termination.
12. Governing law
These Terms are governed by the laws of the State of Hawaii, USA, without regard to its conflict-of-law rules. Venue for any dispute lies in the state or federal courts located in Hawaii, and you consent to their jurisdiction. (See REVIEW-NOTES: confirm governing-law jurisdiction.)
13. Changes to these Terms
We may update these Terms as the Software evolves. We will post the updated version at this URL and revise the "Last updated" date. Continued use after changes take effect constitutes acceptance.
